Welcome to AXISPEED.  ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website www.axispeed.com (the "Site") and the purchase of products from us. By placing an order, you agree to be bound by these Terms.

1. General Information

We are an online retailer based in Guangzhou City, P.R.CHINA, specializing in high-performance sports equipment including but not limited to cycling helmets, ski goggles, golf gear, and other action sports accessories that we will ship worldwide.

2. Product Safety and Risk Warning

Our products are designed for extreme sports. You acknowledge and accept the inherent risks associated with these activities.

• Quality Certification: Most of protective gear (helmets, pads, etc.) complies with relevant international safety standards refer to the item's detail introduction (e.g., CE or EN1078, or CPSC,or CNAS/NZS). Although some items have not applied for international standard certification due to the cost control, they still passed the strict domestic safety tests in China，customers can purchase them with safety of mind.  However, compliance does not guarantee absolute protection against injury or death.

• No Guarantee of Performance: We do not warrant that the use of our products will prevent all injuries. The performance of safety equipment depends on proper fit, correct usage, and environmental factors beyond our control.

• User Responsibility: It is your responsibility to ensure the product fits correctly and is suitable for your intended activity. If you are unsure, consult a professional before use.

3. Orders and Payment

• Order Acceptance: Your placement of an order constitutes an offer to buy. We reserve the right to refuse or cancel any order for reasons including stock availability, errors in pricing, or suspected fraud.

• Pricing: All prices are listed in [Currency, e.g., USD]. Prices do not include applicable import duties, taxes, or customs clearance fees, which are the sole responsibility of the customer.

• Payment: We accept major credit cards and payment gateways (e.g. PayPal). All payments are processed securely through third-party providers.

4. International Shipping and Customs

• All goods are shipped  directly from China mainland. At current stage, we do not use international cloud warehouses to ensure the origin of the goods and achieve the lowest cost.
• Shipping Costs: Due to the weight and size of sports equipment, international shipping can be expensive. Shipping costs are calculated at checkout and are non-refundable except in cases of our error.
• Customs and Duties: You are responsible for all customs duties, import taxes, and brokerage fees imposed by the destination country. We are not liable for delays caused by customs procedures.
• Loss or Damage in Transit: While we package items carefully, we recommend purchasing additional shipping insurance for high-value goods. In the event of loss or damage during transit, we will assist you in filing a claim with the carrier, but our liability is limited to the value of the goods as stated on the shipping invoice.

5. Returns, Refunds, and Hygiene Policy

Given the nature of sports equipment, our return policy is strictly regulated to ensure hygiene and cost-effectiveness.

• Hygienic Products: For health and safety reasons, the following items are considered "hygienic" and are non-returnable once opened, worn, or used: Helmets (including inner padding), sunglasses/goggles (worn on face), mouthguards, socks, base layers, and swimwear.

• Eligibility for Return: You may return unworn, unopened, and resalable items within 7 days of delivery. To be eligible, items must be returned in their original packaging with all tags attached.

• Return Shipping Costs: You bear the full cost of return shipping. Given the high cost of international logistics, returning an item due to "change of mind" or incorrect sizing often exceeds the value of the merchandise itself. Please refer to our Size Guide carefully before ordering.

• Refunds: Once we receive and inspect the returned item, we will process a refund minus the original shipping fee and any applicable restocking fees ($20-$50 depending on the item category).

6. Warranty Claims

We offer a limited warranty against manufacturing defects.

• Manufacturing Defects: If you receive a product with a genuine defect in materials or workmanship (e.g., helmet shell cracked upon arrival, lens delaminated), please contact us within 7days with photos/videos. We will replace the item free of charge or issue a refund if no replacement is available.

• Exclusions: This warranty does NOT cover:

  ◦ Normal wear and tear (scratched lenses, faded graphics).

  ◦ Damage caused by impact, misuse, or accidents.

  ◦ Cosmetic blemishes that do not affect function.

  ◦ Improper care or storage.

7. Intellectual Property and Prohibited Use

• All content on this Site, including product designs, logos, and photography, is the property of AXISPEED.COM and PLATINUM TECHNOLOGY DEVELOPMENT GUANGZHOU LTD. (Chinese Pinyin translation: BAITIAN JIANJIA KEJI FAZHAN GUANGZHOU YOUXIAN GONGSI). Itis protected by international copyright laws.

• You may not use our images to create counterfeit products or list them on other marketplaces without explicit written permission.

8. Limitation of Liability

In no event shall [Your Brand Name] be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your purchase, even if we have been advised of the possibility of such damages. Our total liability to you for any claims shall not exceed the amount you paid for the product.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Peoples Republic of CHINA. Any disputes arising under these Terms shall be resolved exclusively in the courts of GUANGZHOU CITY, P.R.CHINA.
